Can I Still Get Screwed Over Despite the FARE Act?

June 23, 2025
The FARE Act adds protections, but is it foolproof? Here’s what to watch out for so you don’t get caught off guard.

What sketchy workarounds are landlords trying?

"Application fees" over $20 are red flags. The law sets a maximum application fee limit, and anything higher is often disguised broker fees.

"Mandatory move-in services" costing hundreds for basic tasks like key programming or apartment cleaning weren't disclosed upfront.

What other tricks should I watch for?

Landlords requiring you to use specific moving companies that kick fees back to them. You should be able to hire any licensed mover.

"Administrative processing fees" that weren't mentioned in the original listing violate the transparency requirements.

Mystery charges for "concierge coordination" or "leasing administration" that somehow equal exactly what broker fees used to cost.

How do I protect myself from these scams?

Screenshot every listing and save all communication about fees before viewing apartments.

The law includes enforcement by the Department of Consumer and Worker Protection with fines starting at $750.

Report violations at nyc.gov/dcp. Your complaint helps protect other renters and strengthens enforcement.
